Terms of Service

1. Acceptance of these Terms

These Terms of Service (the “Terms”) constitute a legally binding agreement between you and Fantasy ROI Inc. (“Fantasy ROI,” “we,” “us” or “our”). Fantasy ROI operates a subscription-based online dashboard and analytics service that allows users to view, consolidate and analyse data from their fantasy-sports accounts across multiple platforms (the “Services”). By creating an account, subscribing to the Services or otherwise accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services. We may update the Terms from time to time; we will provide notice of material changes, and your continued use of the Services constitutes your acceptance of the updated Terms.

2. Description of the Services

Fantasy ROI provides tools that aggregate and analyse fantasy-sports information from accounts you maintain with third-party fantasy platforms (such as Drafters, Underdog, FFPC or similar sites). The Services allow you to manually enter results or upload screenshots of your fantasy accounts so that we can extract relevant statistics. Where a Third-Party Platform makes authorised APIs or tokens available, you may choose to grant us permission to retrieve data programmatically on your behalf. In each case, we use the information you provide to display statistics, performance reports and personalized analytics to you.

Fantasy ROI does not operate fantasy contests, drafts, betting, gambling or prize-based competitions; we simply provide analytics and dashboards. We do not accept deposits for contest entry or hold player funds (other than subscription payments described below), and we are not affiliated with any fantasy-sports platform. The analytics we provide are for entertainment and informational purposes only and do not constitute financial advice or recommendations.

3. Eligibility

Age and Capacity

You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. By opening an account, you represent and warrant that you meet these requirements and that the information you provide is truthful, accurate and complete. If you are under the age of eighteen, you may not use the Services.

Jurisdiction and Compliance

You are responsible for ensuring that your use of the Services complies with all laws, rules and regulations applicable in your country, state or province. Because we do not offer contests, many of the jurisdictional restrictions that apply to fantasy-contest operators may not apply to Fantasy ROI. However, some jurisdictions restrict the collection or processing of data from certain third-party services. You represent that your use of the Services, including any transfer of data from external platforms, is lawful in your jurisdiction.

Account Registration

To use the Services you must register and create an account. You agree to provide accurate, current and complete information during registration and to update such information to keep it accurate. You may not create more than one account, and your account is not transferable. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Subscription and Billing

Subscription Plans

Access to certain features of the Services requires payment of subscription fees. We will present the pricing and terms for subscription plans at the time of purchase. Prices and features may change, but changes will not affect existing subscriptions until the next renewal period.

Billing

When you subscribe, you authorize us (or our third-party payment processor) to charge your selected payment method for the subscription fee and any applicable taxes. Subscriptions may automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time in your account settings; cancellation will take effect at the end of your current billing period.

Refunds

Except as required by law, subscription fees are non-refundable. If we suspend or terminate your account for breach of these Terms, you will not be entitled to a refund.

5. Third-Party Platforms and Data

User Permissions and Compliance

To provide the Services, we may ask you to supply fantasy-sports statistics via manual entry, screenshots, API tokens or other credentials for your accounts on third-party fantasy platforms (“Third-Party Platforms”). You represent and warrant that you have the lawful right to share this data and that doing so does not violate the terms, conditions or policies of the applicable Third-Party Platform. You agree not to provide any credentials or data that you are not authorized to share and not to use the Services to circumvent technical or contractual restrictions imposed by those platforms. You are solely responsible for complying with the third-party terms governing your accounts.

Use of Third-Party Data

We will use the information we obtain from Third-Party Platforms solely to provide and improve the Services. We will not share your third-party account credentials with unaffiliated third parties. We rely on the accuracy of the data supplied or retrieved; we do not warrant that data from Third-Party Platforms or extracted from screenshots is complete, timely or error-free, and we are not responsible for any discrepancies between our analytics and the underlying platform data.

Service Availability

Access to data from Third-Party Platforms depends on the continued availability of those platforms and their willingness to allow our retrieval methods. Third-Party Platforms may modify, restrict or terminate our ability to access your data without notice. We will not be liable for any loss or interruption of the Services caused by changes in third-party systems or policies.

No Affiliation

Fantasy ROI is an independent service and is not endorsed by or affiliated with any fantasy-sports or sports-analytics platform. All trademarks, trade names and other intellectual property of Third-Party Platforms belong to their respective owners.

6. User Content and Intellectual Property

Ownership of the Services

The Site and Services, including all software, text, graphics, images, audio clips, video clips, interfaces and the compilation of content, are owned by Fantasy ROI or its licensors and are protected by copyright and other intellectual property laws. We grant you a limited, revocable licence to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, publicly display, modify, create derivative works of or otherwise exploit any part of the Services without our express written consent.

User Content

You may submit or upload content (such as team names, comments, screenshots or other materials) through the Services. You retain ownership of your content, but by submitting it you grant Fantasy ROI a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, modify and distribute your content solely in connection with providing the Services and for promotional purposes. You are responsible for ensuring that your content does not infringe any third-party rights or violate any laws.

Feedback

If you provide feedback, comments or suggestions regarding the Services, you grant Fantasy ROI a perpetual, irrevocable, non-exclusive, royalty-free licence to use that feedback for any purpose without compensation to you.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use and disclose your information. By using the Services, you consent to our privacy practices.

8. Prohibited Activities

You agree not to:

• Use the Services for any illegal purpose or in violation of any law or regulation;
• Reverse engineer, decompile or otherwise attempt to discover the source code of the Services;
• Circumvent or disable any security features of the Services or attempt to gain unauthorized access to any part of the Services;
• Use any robot, spider, scraper or other automated means to access the Services without our express written permission;
• Harass, threaten, defame or abuse other users or post content that is obscene, hateful, discriminatory or otherwise objectionable;
• Upload or transmit viruses, worms or other malicious code;
• Attempt to misrepresent your identity or affiliation with any person or entity;
• Provide us with any third-party account credentials, screenshots or data that you are not legally authorized to share, or use our Services to bypass third-party terms or technical restrictions.

We may investigate and/or terminate your account if you engage in prohibited activities or violate these Terms.

9. Indemnification

You agree to indemnify, defend and hold harmless Fantasy ROI and its affiliates, officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses (including legal fees) arising out of or relating to your violation of these Terms, your use of the Services, your user content or your unauthorized use of Third-Party Platform data.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. Fantasy ROI does not warrant that the Services will be uninterrupted or error-free, that the results obtained from using the Services will be accurate or reliable, or that the Services or any data we display will meet your expectations. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of Liability

To the extent permitted by law, Fantasy ROI and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Services, including loss of profits, data or goodwill, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Services will not exceed the greater of (a) the total amount you paid to Fantasy ROI for the Services during the six (6) months prior to the event giving rise to the claim and (b) fifty Canadian dollars (CAD $50).

12. Modification of the Services and Terms

We reserve the right to modify, suspend or discontinue the Services (in whole or in part) at any time. We may also modify these Terms; if we do, we will provide notice of material changes. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you disagree with any changes, you may terminate your account before the changes take effect.

13. Governing Law and Dispute Resolution

These Terms and the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Ontario for any dispute arising out of these Terms or your use of the Services. To the extent permitted by law, you and Fantasy ROI waive any right to participate in a class action or representative proceeding.
